Privacy Policy

The Actuarial Toolkit is governed by the Society of Actuaries Terms of Use and Privacy Policy.  In addition to those terms and conditions for use, by using the R Console (“Console”), you agree to these specific terms of use (“Console terms”).

1. DEFINITIONS
The “Console” shall mean the proprietary suite of software facilities for data manipulation, calculation and graphical display, including programming code, data sets, and graphs provided by the Society of Actuaries (“SOA”) through the R Console website, designed to allow individuals to develop and test programming code for predictive analytics purposes, to be used online and any upgrades from time to time and any other software or documentation which enables the use of the Console. 

2. DATA PROTECTION
The Console may collect information about you and your use of the software, and send that to the SOA. The SOA may use this information to provide services and improve our products and services in accordance with our Privacy Policy. Your use of the Console operates as your consent to these practices.

3. PROPRIETARY RIGHTS AND LICENSE
All trademarks, copyright, and other intellectual property rights of any nature in the Console together with the underlying software code are owned either directly by the SOA or by its licensors. Unless otherwise stated, users may use and execute code or download information from this site for personal and/or educational, non-commercial use only, provided they identify the source of the material. 

4. CONDITIONS OF USE
In order to execute and manipulate the Console, you must be a registered user and have a MySOA account. The information you provide at the time of registration will be used in accordance with our Privacy Policy. You are solely responsible for maintaining the confidentiality of your account, username, and password. You further understand that you are completely responsible for all activities associated with your account.

You warrant that your account related information will be accurate, current, and complete at all times. If we believe that such information is untrue, inaccurate, not current, incomplete, or misleading, then we reserve the right to suspend or terminate your account and restrict any and all current or future use of our products and services, without any liability to you.

You must notify us immediately of any unauthorized use of your account and any other breach of security. We cannot be held responsible for any loss or damage arising out of your failure or negligence to comply with the requirements stated in this agreement, either with or without your knowledge, prior to your notifying us of unauthorized access to your account.

You may not use anyone else's account at any time or transfer your account to someone else without the permission of the account holder. If you have authorized another individual, including a minor, to use your account, you understand under such circumstances, you are completely responsible for the online conduct of such user and the consequences of any misuse.

You will not, nor allow third parties on your behalf, to (i) make and distribute copies of the Console; (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Console; (iii) create derivative works of the Console of any kind whatsoever; (iv) use the Console in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Console terms, or act fraudulently or maliciously for example by hacking into or inserting malicious code into the Console or other operating systems; (v) or use the Console in a way that could damage, disable, overburden, impair or compromise the SOA or Academy, their systems or security or interfere with other users.

The Console is currently made available to you for your personal and/or educational, non-commercial use. The SOA reserves the right, in its sole discretion, at any time and for any reason, to (i) amend or withdraw the Console, (ii) change the terms and conditions upon which the Console is provided, (iii) charge for the Console or service provided to you in accordance with these Console terms, (iv) or, without notice, terminate or otherwise limit your access to the Console in the event that we believe that you are in breach of or have failed to comply with any of the Console terms.

5. AVAILABILITY
The SOA will use reasonable efforts to make the Console available at all times. However, you acknowledge the Console may be affected by factors outside of the SOA’s reasonable control and may be rendered unavailable during periods of maintenance. The SOA does not accept any responsibility whatsoever for unavailability of the Console, or any difficulty or inability to download or access content or any other communication system failure which may result in the Console being unavailable.

The SOA will provide support and/or maintenance for the Console. Support for Console errors or defects is available by emailing customerservice@soa.org. The SOA will not be responsible for ensuring 100% availability of the application, and email support is only offered from 8:00 AM. – 5:00 PM Central and 9:00 AM  – 6:00 PM. 6. DISCLAIMER OF WARRANTIES
You assume full responsibility for using the information provided through the Console. The SOA makes no warranty, guarantee, or representation as to the accuracy or sufficiency of the information provided through the Console.

The SOA disclaims all express and implied warranties with regard to the Console. The Console is provided "as is" and "as available". THE SOA EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY OR RESPONSIBILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF ANY INDIVIDUAL'S USE OF, REFERENCE TO, RELIANCE ON, OR INABILITY TO USE, THE CONSOLE OR THE INFORMATION PRESENTED IN THE CONSOLE.
